This Privacy Policy explains how FRP POWERSPORTS, INC ("FRP," "we," "us," or "our") collects, uses, stores, shares, and protects your personal information when you use our electric motorcycle companion mobile application and related services (collectively, the "Services").
By downloading, accessing, or using the Services, you acknowledge that you have read, understood, and agreed to the practices described in this Privacy Policy. If you do not agree with this Policy, please discontinue use of the Services.
2. Information We Collect
A. Information You Provide Directly
- Account Information: Including your name, email address, phone number, password, and other information required to create an account.
- Profile Information: Avatar, nickname, personal bio, and other information you upload to the community.
- User-Generated Content: Photos, videos, ride records, routes, comments, and other content you post.
- Payment Information (for service renewals only): When you renew or top up SIM card data or subscription services via credit card or PayPal, a third-party payment processor (such as Stripe, PayPal, Apple Pay, or Google Pay) collects your payment card details. FRP does not store complete payment card numbers on its servers. Note: The in-app “Store” feature is a web redirect only and does not collect payment information through this application.
- Communication Records: Records of your communications with us through customer service or other channels.
B. Information Collected Automatically
- Device Information: Including device identifiers (such as IDFA, AAID), device model, operating system, IP address, carrier information, language settings, crash logs, and performance data.
- Location Information: Precise GPS location is essential for remote vehicle control, vehicle locating, anti-theft alerts, ride route recording, and community features. You may disable location permissions in your system settings, but doing so will affect the proper functioning of core features.
- App Usage Information: How you use the application, including the features you use, pages you view, time spent, and interaction behavior.
3. How We Use Your Information
We use your information for the following purposes:
- To provide, operate, and improve our core Services (account authentication, remote vehicle control, ride tracking, community platform, store, etc.).
- To personalize recommended content, routes, or products and enhance your experience.
- To process orders and send transactional information (such as payment confirmations).
- To communicate with you regarding product updates, security alerts, maintenance notices, and similar matters.
- To improve product performance and user experience through data analysis and research.
- To safeguard the security and integrity of the Services, users, and vehicles.
- To comply with applicable laws and regulations and fulfill compliance obligations.
4. How We Share Your Information
We do not sell your personal information to third parties for their marketing purposes. We share information only in the following circumstances:
- Service Providers: We share information with contractually bound third-party vendors, such as cloud hosting (e.g., AWS), data analytics services, payment processors, and customer support providers. These vendors are required by contract to protect your data.
- Legal Requirements: We may share relevant data when we reasonably believe it is necessary to comply with laws, regulations, legal processes, or government requests, or to protect the safety of FRP, our users, or the public.
- Business Transactions: In connection with a merger, acquisition, asset sale, financing, or corporate restructuring, your personal information may be transferred as part of the transaction.
- With Your Consent: We may share your information for other purposes with your explicit consent.
5. Your Privacy Rights (for Users in California and Other U.S. Regions)
Under privacy laws such as the California Consumer Privacy Act (CCPA/CPRA), you have the following rights:
- Right to Know and Access: The right to know what personal information we collect, use, and share.
- Right to Delete: The right to request deletion of your personal information (subject to certain exceptions).
- Right to Correct: The right to request correction of inaccurate information.
- Right to Opt Out of “Sale” or “Sharing”: We do not engage in the traditional “sale” of data, but certain analytics or advertising cookies may be considered “sharing.” You may opt out through the entry point in the App footer.
- Right to Non-Discrimination: FRP will not treat you differently for exercising your privacy rights.

6. Data Security
We implement reasonable administrative, technical, and physical measures to protect your information, including encryption during data transmission and storage. Please note that no method of internet transmission or electronic storage can guarantee 100% security.
7. Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes described in this Policy, or for the period required or permitted by law. Once the information is no longer needed, we securely delete or anonymize it.
Retention of Transaction Records: Based on legal and anti-fraud requirements, transaction records of vehicle transfers (such as payment screenshots) may be retained for a longer period than general app usage data.
8. International Data Transfers
To provide global services, your personal information may be transferred outside of your region. To ensure legal compliance:
- Unified Data Controller: The FRP global application is controlled by the same legal entity, FRP POWERSPORTS, INC, which is responsible for data control.

Regional Data Storage:
- EU user data is stored in the EU region (compliant with GDPR).
- U.S. user data is stored in the U.S. region (compliant with CCPA).
- Other Asia-Pacific user data is stored in FRP-designated regions.
- Cross-border data transfers are carried out based on lawful mechanisms such as Standard Contractual Clauses (SCCs).
- Unified Account System: FRP uses a unified global identity system (such as AWS Cognito / Auth0 / Firebase Auth), ensuring users can log in globally while user data is still stored locally in accordance with legal requirements.
9. Children's Privacy
The Services are not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. If we discover that such information has been collected in error, we will delete it immediately. This provision complies with the U.S. Children's Online Privacy Protection Act (COPPA).
10. Changes to This Policy
We may update this Policy from time to time, and the most recent version will be marked with a "Last Updated" date at the top. For material changes, we will notify you through the App or by email. Your continued use of the Services constitutes acceptance of the updated Policy.
